Terms & Conditions

These Terms & Conditions govern your use of Engage (the "Service"), a web application for creating interactive surveys and engagements. The Service is provided by GoArchitect LLC ("GoArchitect", "we", "us"), trading as Engage. When you use the Service, you are contracting with GoArchitect LLC.

1. Acceptance of these terms

By creating an account, accessing, or continuing to use the Service, you agree to these terms. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization. If you use it as an individual, you confirm you are of legal age in your jurisdiction.

2. The Service

Engage lets you build surveys and interactive engagements (including image-based sticky notes, action dots, drawing canvases, and standard question types), share them by link, and review the responses you collect. Features may change or improve over time.

3. Your account

• You must provide accurate account information and keep it up to date.
• You are responsible for keeping your credentials confidential and for all activity under your account.
• Organization owners and admins control who may access an organization's surveys and response data.

4. Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for any unlawful purpose or to collect data unlawfully;
• send spam, run fraudulent surveys, or misrepresent who is collecting responses;
• upload or distribute content that infringes another party's intellectual property;
• interfere with the security or integrity of the Service, including uploading malware, probing or scanning our systems, bypassing rate limits, or scraping data;
• collect sensitive personal data from respondents without a lawful basis and appropriate notice.

5. Your content

You retain ownership of the surveys, images, and response data you create or collect. You grant us a limited licence to host, store, process, and display that content solely to provide and support the Service. You are responsible for having the rights to any content you upload and for how you use the responses you collect.

6. Our intellectual property

GoArchitect LLC retains all rights in the Service, including its software, interfaces, documentation, and branding. You receive a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected. You may not reverse engineer the Service, resell or redistribute it, or circumvent technical limits.

7. Plans, payment, and subscriptions

Engage offers a free plan and a Pro plan billed per organization on an annual basis. Current prices are shown on our pricing page.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, applicable taxes, subscription renewal, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. Our own refund commitment is described in our Refund Policy. Unless cancelled, Pro subscriptions renew automatically for a further annual term.

8. Service level

We work to keep Engage available and reliable, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access to the Service where:

• you materially breach these terms;
• payment for a paid plan fails or is not made;
• there is a security, legal, or fraud risk arising from your use;
• you repeatedly or seriously violate the acceptable use rules above.

You may stop using the Service at any time and may cancel a Pro subscription. On termination, you may export your response data for a reasonable period before it is deleted.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising from the Service is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.

11. Indemnity

You will indemnify GoArchitect LLC against claims arising from your content, your unlawful use of the Service, or your breach of these terms.

12. General

These terms are governed by the laws of the State of Illinois, USA, and disputes are subject to the courts located there. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms; continued use after an update constitutes acceptance.
